RMS Graphics, Inc. (“RMS,” “we”, ”our”) are committed to protecting your privacy. This privacy policy applies to data we collect when you use our website and services that link to this privacy policy (collectively, the "Services") or when you otherwise interact with us. There are various ways that you might interact with RMS, and the data you provide when doing so allows us to improve our services. By using this website (“Site”) and by supplying your details to RMS, you consent to RMS collecting and processing your data.

Data We Collect & Share

RMS may collect or record basic personal data (e.g., name, e-mail address, mailing address, phone number) which you voluntarily provide through forms on our Site, electronic mail you send to us, or through other means of communication between you and RMS. RMS only collects personal data of a more sensitive nature (e.g. credit card details and account numbers) where it is appropriate or necessary for conducting business. This data will be collected and processed in a secure manner.

RMS also collects, uses, and discloses identifiable data about individual contacts for RMS's customers (“Business Contact Data”) in the ordinary course of its business for managing and maintaining customer relationships. In particular, RMS may obtain the following types of Business Contact data: name, address, invoice data, and order data. Unless otherwise specified or prohibited, RMS may share data with affiliates, business partners, service providers, subsidiaries or contractors who are required to provide you with services which you have requested from us.

RMS may also post links to third party websites as a service to you. These third party websites are operated by companies that are outside of our control, and your activities at those third party websites will be governed by the policies and practices of those third parties. How We Use data

RMS uses the data we collect to provide you with services which you request and to improve our existing services and the content of our Site. When you contact RMS, we may keep a record of your communication to help solve any issues that you might be facing. Depending on the country in which you live, work or access our Site(s), your data may be retained for a reasonable time for use in future contact with you, or for future improvements to RMS services. You have the option to opt-out or opt-in for further communications from RMS.

RMS may also use or disclose your personal data when RMS believes, in good faith, that such use or disclosure is reasonably necessary to (i) comply with law, (ii) protect the rights, property or safety of RMS, RMS users, or others. RMS reserves the right to transfer and disclose your data if RMS becomes involved in a business divestiture, change of control, sale, merger, or acquisition of all or a part of its business.

Web User Tracking – Use of Cookies

Cookies are a technology that can be used to help personalize your use of a website. A cookie is an element of data that a website can send to your browser, which may then store it on your system. Security

The Internet by its nature is a public forum, and RMS encourages you to use caution when disclosing data online. Often, you are in the best situation to protect yourself online. You are responsible for protecting your username and password from third party access, and for selecting passwords that are secure.

Monitoring and Enforcement

RMS regularly reviews our compliance with our privacy policy. We also adhere to several self-regulatory frameworks in addition to complying with applicable law. If we receive formal written complaints, we will follow up with the person making the complaint. We work with the appropriate regulatory authorities to resolve any complaints that cannot be resolved directly.

Privacy Shield (European Union)

RMS complies with the EU-U.S Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use and retention of personal data transferred from the European Union (EU) to the United States. RMS has certified to the Department of Commerce that is adheres to the Privacy Shield Principals. If there is any conflict between the terms of this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. RMS may obtain in the US the following types of EU information: name, address, invoice information including bank account information, and order information (“EU Business Contact Information”). RMS uses EU Business Contact Information for the following purposes: managing customer relationships, managing orders, tracking payments and ensuring payment, and otherwise maintaining the customer relationship. RMS may disclose EU Business Contact Information to its affiliates, subsidiaries, business partners, and service providers for the purposes listed above.

In situations where RMS discloses (ie onward transfers) EU Business Contact Information to any third parties acting as service providers or "agents" on behalf of RMS, RMS will require the recipient to protect the disclosed EU Business Contact Information in accordance with the relevant Privacy Shield Principles, or otherwise take steps to ensure that the EU Business Contact Information is appropriately protected. With respect to any sharing of EU Business Contact Information for the purposes of marketing RMS products and services, RMS obtains guarantees from its affiliates, subsidiaries and business partners that such entities will not use and disclose such EU Business Contact Information. In cases of onward transfer of EU Business Information to third parties pursuant to Privacy Shield, RMS is potentially liable in the event of an improper disclosure. In certain situations, individuals may seek to opt-out of disclosures of their EU Business Contact Information by contacting RMS as specified in the “Contacting RMS” section below.

RMS takes appropriate technical and organizational measures to safeguard EU personal data against unauthorized or unlawful processing of, or accidental loss, damage, misuse, unauthorized access, unauthorized disclosure, unauthorized alteration, or destruction, and maintains reasonable procedures to help ensure that such information is relevant for its intended use, accurate, complete, current and not excessive and that such information is not retained longer than is reasonably necessary.

With respect to personal data received or transferred pursuant to the Privacy Shield Framework, RMS is subject to the regulatory enforcement powers of the United States Federal Trade Commission. In certain situations, RMS may disclose EU personal data as necessary in connection with the sale or transfer of all or part of its business, where required or permitted by law, where RMS believes that such disclosures are appropriate in connection with a law enforcement request or as otherwise permitted by the Privacy Shield Principles, or in order to investigate, prevent or take action regarding illegal activities or suspected fraud or in order to comply with, enforce or apply RMS agreements. In compliance with the Privacy Shield Principles, RMS commits to resolve complaints about our collection or use of your personal data at no cost to the individual. Dispute Resolution

Within the scope of this privacy notice, if a privacy complaint or dispute cannot be resolved through RMS Graphics, Inc.’s internal processes, RMS Graphics, Inc. has agreed to participate in the VeraSafe Privacy Shield Dispute Resolution Procedure. Subject to the terms of the VeraSafe Privacy Shield Dispute Resolution Procedure, VeraSafe will provide appropriate recourse free of charge to you. Under certain conditions, more fully described on the Privacy Shield website [https://www.privacyshield.gov/article?id=How-to-Submit-a-Complaint], you may invoke binding arbitration when other dispute resolution procedures have been exhausted.

Data Processor Activities

RMS operates as a data processor for our business customers located in the US, EU and other geographic locations worldwide. RMS's business customers remain the data controllers with respect to any Customer data that they provide to RMS for our provision of services. RMS therefore acts in accordance with the instructions of such customers regarding the collection, processing, storage, deletion and transfer of Customer data, as well as other matters such as the provision of access to and rectification of this Customer data.

Children's Online Privacy Protection - COPPA

RMS does not sell its services to children. As such, our Sites are designed for adult user interaction. We do not intentionally collect personally identifiable data from children under the age of 13.

Changes to this Privacy Policy

RMS may change this privacy policy from time to time. If this privacy policy changes, the revised privacy policy will be posted at the "Privacy Policy " link on the Site's home page. In the event that the change is significant or material, we will notify you of such a change by revising the link on the homepage to read "Newly Revised Privacy Policy." Please check the privacy policy frequently. Your continued use of the Site constitutes acceptance of such changes in the privacy policy, except where further steps are required by applicable law.
